1. Introduction

These Terms and Conditions govern your use of the website www.kalestruck.com and any commercial relationship between you (“the Customer”) and Shandong Kales Vehicle Co., Ltd. (“Kales Vehicle,” “we,” or “us”), a leading Chinese manufacturer of heavy-duty semi-trailers based in Liangshan County, Shandong Province, China.

We specialize in designing and exporting custom-built semi-trailers, including lowbed trailers, ADR tanker trailers, bulk cement tankers, tipper trailers, and curtain side semi-trailers, serving clients across Africa, Latin America, the Middle East, and Southeast Asia.

By requesting a quotation, submitting an inquiry, signing a purchase agreement, or using our services, you agree to be bound by these Terms and Conditions in full. If you do not agree, please refrain from engaging in any commercial interaction with us.

2. Website Use

The website www.kalestruck.com is provided for informational and commercial purposes only. We do not guarantee that:

Technical information (e.g., dimensions, payload capacity, materials) is error-free;
Product images accurately reflect the final configuration of your semi-trailer order from China;
Prices displayed online are binding without a formal Proforma Invoice.

All quotations must be confirmed via an official written document (PDF or digitally signed email).

3. Quotations and Proforma Invoices

Initial quotations are estimates only and valid for 7 business days, unless otherwise stated.
The final price is specified exclusively in the Proforma Invoice issued by Kales Vehicle, which includes:
- Detailed technical specifications;
- Delivery terms (Incoterms, typically FOB Qingdao or CIF [destination port]);
- Production lead time (usually 15–25 working days after order confirmation);
- Payment terms (typically 30% advance payment, 70% payable upon completion of production and prior to factory release).
Any modifications requested after order placement (e.g., axle configuration, tank volume, body type) may affect pricing and delivery schedule.

4. Orders and Payments

An order is considered confirmed only upon receipt of the advance payment and written acceptance of the Proforma Invoice.
Kales Vehicle reserves the right to decline orders due to legal, logistical, or credit risk considerations.
Payments must be made in USD via bank wire transfer, PayPal (with a 4% surcharge), or other methods agreed upon in writing.
Custom-built products—including ADR-certified hazardous material tankers, multi-axle lowbed trailers, and pneumatic bulk cement semi-trailers—are non-returnable, except in cases of verified manufacturing defects.
The balance payment (70%) must be settled in full before the vehicle leaves our factory in Quanpu Industrial Park. We will provide high-resolution photos and real-time video of the completed unit for your verification prior to release.

5. Production, Inspection, and Delivery

Production begins upon receipt of the advance payment at our semi-trailer manufacturing facility in Liangshan, China.
We offer real-time pre-shipment video inspections for all units, especially for specialized equipment such as ADR tanker trailers and bulk powder transport semi-trailers.
Customers may arrange third-party inspections (e.g., SGS, Bureau Veritas) at their own expense.
Delivery timelines may be affected by:
- Delays in design or specification approval;
- Availability of key components (e.g., high-tensile steel, BPW/SAF axles, JOST landing gear);
- Force majeure events (e.g., pandemics, port congestion, international sanctions).
All shipments originate from Qingdao Port, China (FOB Qingdao) unless otherwise agreed in the Proforma Invoice.

6. Certifications and Compliance

All heavy-duty semi-trailers produced by Kales Vehicle comply with Chinese national manufacturing standards.
Tanker trailers for hazardous materials will be built to ADR regulations only if explicitly specified in the Proforma Invoice.
Kales Vehicle assumes no responsibility for regulatory non-compliance, import restrictions, or homologation failures in the destination country if the Customer fails to provide clear technical, safety, or legal requirements prior to production.

7. Intellectual Property

All content on this website—including designs, engineering drawings, product photos, logos, and technical documentation—is the exclusive property of Kales Vehicle.

Unauthorized reproduction, distribution, or commercial use of our materials is strictly prohibited without prior written consent.

8. Limitation of Liability

Kales Vehicle shall not be liable for:

Indirect, incidental, or consequential damages, including lost profits or business interruption;
Delays or penalties arising from customs clearance, local import duties, or failure to meet destination-country vehicle standards;
Damage or loss occurring during ocean freight, inland transport, or after delivery under the agreed Incoterm (e.g., FOB Qingdao).

Our total liability in connection with any order shall not exceed the total amount paid by the Customer for that order.

9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the People’s Republic of China.
Any dispute arising out of or in connection with a contract shall first be resolved through good-faith negotiation.
If no amicable resolution is reached within 30 days, the dispute shall be finally settled under the Rules of Arbitration of the China International Economic and Trade Arbitration Commission (CIETAC). The place of arbitration shall be Beijing, China. The arbitral award shall be final and binding upon both parties.

10. Amendments

We reserve the right to update these Terms and Conditions at any time to reflect changes in our operations, legal requirements, or market practices. Revised terms take effect immediately upon publication on www.kalestruck.com. Continued use of our services constitutes acceptance of the updated terms.
