1. Introduction

These Terms and Conditions govern use of www.kalestruck.com and any commercial relationship between you and Shandong Kales Vehicle Co., Ltd., a Chinese manufacturer of heavy-duty semi-trailers based in Liangshan County, Shandong, China.

KALES designs and exports custom semi-trailers including lowbed trailers, ADR tankers, bulk cement tankers, tippers, and curtain side semi-trailers for clients across Africa, Latin America, the Middle East, and Southeast Asia.

By requesting a quotation, submitting an inquiry, signing a purchase agreement, or using our services, you agree to these Terms in full.

2. Website Use

The website is provided for informational and commercial purposes. Technical information, product images, and online pricing are not binding unless confirmed by official written document.

All quotations must be confirmed through a Proforma Invoice or written email confirmation.

3. Quotations and Proforma Invoices

Initial quotations are estimates and valid for 7 business days unless stated otherwise. Final price, specifications, Incoterms, lead time, and payment terms are defined only in the Proforma Invoice.

Changes after order placement may affect price and delivery schedule.

4. Orders and Payments

Orders are confirmed only after advance payment and written acceptance of the Proforma Invoice. KALES may decline orders due to legal, logistical, or credit risk considerations.

Payments are normally made in USD by bank transfer, PayPal with surcharge, or another method agreed in writing. Custom-built products are non-returnable except in verified manufacturing defect cases.

5. Production, Inspection, and Delivery

Production begins after receipt of advance payment. KALES can provide pre-shipment video inspection and customers may arrange third-party inspection at their own expense.

Delivery may be affected by specification approval delays, component availability, port congestion, sanctions, pandemics, or other force majeure events. Shipments normally originate from Qingdao Port unless otherwise agreed.

6. Certifications and Compliance

Heavy-duty semi-trailers are produced according to Chinese manufacturing standards. Hazardous-material tanker trailers are built to ADR requirements only when explicitly specified in the Proforma Invoice.

KALES is not responsible for destination-market regulatory non-compliance if the customer fails to provide clear technical, safety, or legal requirements before production.

7. Intellectual Property

Website content, designs, drawings, product photos, logos, and technical documentation are KALES property. Unauthorized reproduction, distribution, or commercial use is prohibited without prior written consent.

8. Limitation of Liability

KALES is not liable for indirect, incidental, or consequential damages, including lost profits, business interruption, customs delays, local import duties, destination-country compliance failure, or damage during transport after delivery under the agreed Incoterm.

Total liability related to any order shall not exceed the total amount paid by the customer for that order.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People's Republic of China. Disputes should first be resolved through good-faith negotiation.

If no amicable resolution is reached within 30 days, disputes shall be finally settled under CIETAC arbitration rules in Beijing, China.

10. Amendments

KALES may update these Terms at any time to reflect operational, legal, or market changes. Revised terms take effect immediately after publication on www.kalestruck.com.
